Epstein not only gives too little weight to the 14th Amendment, it completely ignores Article 6 paragraph 2 "laws of any State to the contrary notwithstanding".
Further, Epstein is no libertarian. Period. In order to claim that label, you need to be an advocate of the non-initiation of force, fraud, and theft against another sentient being. Further, you need to believe that all Rights are Property Rights, starting with the Right of Self Ownership.
Lastly, as corollaries to the above, you need to believe that in order for a crime to have been committed, you need a Perpetrator, a Victim, and real damage done. Absent the tort, there are no real crimes other than arbitrary edicts by our political Masters.
Epstein's argument that the States are "free" to infringe such a basic Human Right is NOT libertarian by any stretch of the imagination.

Agreed. I need no document to know that I have the right to life, liberty and the pursuit of happiness or property as it was orginally stated.

The Constitution, nor any other paper gave me the Right and no paper can therefore take that Right away.
