In the past ten years, pistol braces on AK and AR pistols were of a certain amount of concern for the ATF. And there’s a rumor that they’re up to their old shenanigans again. Whether it’s true or not is hard to know, but if you own or intend to purchase such a weapon sometime soon, this is something to be aware of.
Here we go again. If you recall, the ATF, unfortunately, has a history of backpedaling pre-established decisions and interpretations of the law and later changing their minds. The Bump Stock Ban is a great example where they took a pre-established firearm accessory and changed the narrative to claim that they are now considered machine guns. If you want to refresh your memory read my analysis of the bump stock ban. Recently news has broken from Congressman Gaetz about the ATF’s secret brace ban.
BREAKING: ATF Issues Cease And Desist For Honey Badger Pistol
TFB- Luke C.
Firearms Manufacturer Q LLC announced today that it was issued a Cease and Desist by the Bureau of Alcohol Tobacco and Firearms. The ATF’s letter notified Q that the Honey Badger pistol is now considered a Short barreled rifle (SBR) and ordered them to immediately cease production of the firearm unless it is registered on an ATF Form 2, declaring that they are manufacturing an NFA weapon.
The BATF and White House have been strangely silent about this action, even after many media inquiries (Rogue Agent pulling an elections stunt?)... Contact your Representatives and tell them to rein in (or disband) the BATF...

ATF Goes Rogue Once Again!
Once again, gun owners, manufacturers, and dealers are subject to the whims of the anti-gun bureaucrats who run the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF).
The latest outrage is that they have reclassified Q, LLC’s Honey Badger Pistol as a Short Barrel Rifle (SBR) subject to regulation under the provisions of the National Firearms Act (NFA) including a $200 transfer tax.
Years after approving pistol braces and determining that a brace does not make a pistol into an SBR, rumors started to swirl that ATF was planning to reclassify these particular pistols into SBRs. But shortly after the rumors began, the National Shooting Sports Foundation claimed that they were in contact with ATF and that pistol braces were not being reviewed.
ATF’s new interpretation regarding the Q, LLC Honey Badger Pistol has created uncertainty for all gun owners, manufacturers and dealers. Click here to read the ATF letter to Q, LLC and click here to read Q’s response. This is a relatively simple issue that ATF has complicated.
GOA has had a copy of Gifford’s diabolical plan to outlaw not only pistol braces, but .50 caliber ammunition, certain handguns, and the Mossberg Shockwave for close to two years. Click here and go to page 7 for their false claims about pistol braces.
This is not a coincidence. One of Giffords’ advisors is David Chipman, who they tout as a retired ATF Special Agent. It is entirely plausible that Giffords has quietly worked to convince ATF to take a second look at pistol braces as well as many other previously approved firearms accessories.
Pistol braces have been a source of confusion for ATF for several years. In this letter, ATF said that if a shooter used a brace as a stock, then the firearm would become an SBR. They later retreated from that position. This is but one of the many reasons why GOA is pushing to repeal not just part of but all of the NFA.
The sad reality is that if Congress would do its job and pass legislation such as H.R. 5289, The Home Defense and Competitive Shooting Act, firearms owners would no longer be forced to figure out barrel length or determine if their firearm had a brace or a butt stock. Despite its lengthy name, H.R. 5289 will change federal law and allow SBRs to be bought and sold just like any other rifle. In short, H.R. 5289 removes SBRs from the provisions of the NFA.
The modern reality is that companies like Q, LLC sell tens of thousands of “pistol brace” equipped firearms because of the bureaucratic maze required to own an SBR. American citizens should not be forced to wait as long as nine months, be photographed, fingerprinted and taxed to purchase an SBR.
Or alternatively, they should not be forced to figure out what barrel, brace and receiver combination will make their newly assembled firearm a pistol (and not a rifle) and thus be excluded from the provisions of the NFA.
Here is what you need to do today. Scroll up to contact President Trump and let him know that you are counting on him to put a stop to this new ATF overreach and order them to reinstate the Honey Badger Pistol’s status as a pistol equipped with a brace. Then, contact your member of Congress and insist that they cosponsor H.R. 5289.
If Congress does not act to deregulate SBRs, gun owners will be forced to live in fear that that their handgun will be called an SBR or their Mossberg Shockwave could one day be reclassified as a short barrel shotgun.
Rep. Gaetz: ‘ATF Must Stop Abusing Authority’ on Pistol Arm Braces
Ammoland Inc. Posted on October 9, 2020 by Dave Workman
U.S.A. –-(AmmoLand.com)- Florida Congressman Matt Gaetz (R-1st District) has sent a pair of scathing letters (embeded below and worth the read) to Attorney General William Bar and Acting Director Regina Lombardo at the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), demanding a halt to the agency’s effort to restrict “the possession of certain pistol braces by American citizens.”
Gaetz was joined by six House colleagues—Reps. Bill Posey, W. Gregory Steube, John Rutherford, Ted S. Yoho, Neal P. Dunn, MD, and Daniel Webster—in a June 16 letter critical of what appears to be ATF’s “practice of relying on arbitrary, non-public standards to promulgate general firearms policy hidden from public scrutiny and awareness.” REP. MATT GAETZ
The ATF got bitch-slapped into a holding pattern. But still, Trumps ATF, Trumps DOJ and Trumps White House refuses to address the ATF's actions in this matter...
Suspension of Honey Badger Ban an Opportunity to Find Out Who Authorized It
Ammoland Inc. Posted on October 16, 2020 by David Codrea
U.S.A. – -(Ammoland.com)- “Last Friday, October 9, 2020, our attorneys received a letter from ATF Chief Counsel Joel Roessner ‘temporarily suspending the Cease and Desist letter’ associated with the Honey Badger Pistol by Q®,” Q, LLC announced.
“The letter states that the suspension, ‘will remain in effect for a period of sixty (60) days . . . unless withdrawn or extended by ATF.’ The stated purpose of the suspension is to allow the Department of Justice (‘DOJ’) an opportunity, ‘to further review the applicability of the National Firearms Act to the manufacture and transfer of the model ‘Honey Badger Pistol’ firearm.’”
It also provides an opportunity to get to the bottom of who exactly at ATF has been behind the move before the suspension is withdrawn. That’s because my attorney, Stephen Stamboulieh, filed a Freedom of Information Act request on my behalf asking for documents that could reveal who authorized the determination that the National Firearms Act had been violated and that Q, LLC, and thousands of gun owners could be considered in criminal violation.
ATF Continues Rogue Assault on Common Pistols, Rule of Law
Ammoland Inc. Posted on November 3, 2020
U.S.A. -(AmmoLand.com)- Rogue elements of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) are continuing their assault on certain types of commonly-owned semi-automatic pistols. According to the law firm Wiley, ATF has developed a new interpretation of “handgun” that threatens to curtail the supply of foreign-manufactured pistols and could put many law-abiding gun owners in legal jeopardy.
In early October, NRA-ILA alerted gun owners to an ATF decision regarding firearm manufacturer Q LLC’s Honey Badger pistol. Back in August, ATF sent a cease and desist letter to Q LLC notifying the company that the agency had determined the Honey Badger, which comes equipped with a pistol stabilizing brace – to be subject to the National Firearms Act as a short-barreled rifle.
The determination was very concerning for many in the firearms industry and community, as pistol stabilizing braces have become a popular accessory to many commonly-owned semi-automatic pistols. Since 2012, ATF had repeatedly found that firearms with pistol stabilizing braces, like the one equipped on Q LLC’s Honey Badger pistol, were not “designed, made, and intended to be fired from the shoulder,” and were therefore not subject to regulation under the NFA. With no notice or opportunity for public input, ATF appeared to be reversing course.
Report: ATF Working with Joe Biden to Go After AR-15 Pistol Braces
AWR Hawkins, 16 Nov 20202
A report from the NRA-ILA suggests the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) is already working with former Vice President Joe Biden to go after AR-15 pistol braces.
On October 7, 2020, Breitbart News reported that the ATF reclassified a small sliver of AR-15 pistols with stabilizer braces as Short Barrel Rifles (SBRs), thereby placing them under the purview of the National Firearms Act (NFA).
The pistol targeted by the ATF was made by Q, LLC, and is called the “Honey Badger.” However, the ATF made clear that two other Q, LLC pistols with stabilizer braces — the Sugar Weasel and the Mini Fix — may fall under NFA purview as well.
Three days later, on October 10, 2020, the Trump administration made clear they were looking into the ATF’s decision to reclassify some AR-15 pistols and place them under the NFA.
