However in doing so do it like a professional. The Officer making the error is not the chief of Police or the Supervisor, or the City, or the county Governments. It is the Officer. He is the only one who has a sworn oath in the matter at risk. So get his name or at least as much information as you can. When you appear before what is normally a magistrate (paid clerk) ask for a sheet of paper and 10 minutes to get your thoughts together. Sit on your bench with cuffs and leg irons and write out an affidavit of truth. In this affidavit tell that you are a blood and bone human being and that your name is Xxxxx Xxxxxx Xxxxxxx. That you were not a criminal, a suspect, or a perpetrator and as such your detention without a Judicial order accompanied by 2 sworn statements by a citizen of the State is not valid under the Constitution of the united States of America and the state of _________. Tell how they captured you in violation of your rights under the Constitution that they swore to defend in their oath and as such that you wish to ask that they be charged in a court of law with such a violation.
Sign this document and present it to the Magistrate who is a clerk of the court and if he refuses simply advise him that you will be asking for his arrest also. Sit down and say and sign nothing.
