Agent Terry’s Family Denied Crime Victim Status In Gun Walker Caseby John Hayward, Posted 08/11/2011 ET, Updated 08/11/2011 ET Border Patrol agent Brian Terry’s murder at the hands of Mexican criminals carrying at least one weapon from the ATF’s “Operation Fast and Furious” brought that awful program to a screeching halt. The straw purchaser who secured the weapon carried by Terry’s killers, a 23-year-old Phoenix man named Jamie Avila, is now on trial for gun-trafficking offenses. Agent Terry’s family asked to be granted status as crime victims, so they could talk with prosecutors and speak at Avila’s sentencing. It’s a routine request… but to the surprise of many observers, the U.S. Attorney’s office in Arizona has denied them. William LaJeunesse of Fox News reports: U.S. Attorney Dennis Burke argues because the family was not "directly or proximately harmed" by the illegal purchase of the murder weapon, it does not meet the definition of "crime victim" in the Avila case. I hate to say this but that is a good call. The man on trial is on trial on a bogus charge to save some ATF superior's career. He walked into a Gun store and bought a high power rifle. He later decided that he need the money more than the Rifle and sold it. These are, under our 2nd Amendment rights, which extend to anyone living in this country, lawful activities. However if he knew that it would be used in the completion of a crime he could be charged with Mistreason to a Felony. Mr. Terry was shot by another felon not the one who the charged man sold his rifle to. These too are our rights as Americans. Do we want to throw them out? I know I am extending to the dirt bag a lot of leeway. However I would like the same leeway if I sell a Rifle and later it shows up in some criminals hands. How about you?
