Gun Ownership Rights Aren't As Safe As Many Thinkby Tyler Durden, Sun, 09/23/2018 - 21:15, Authored by Jose Nino via The Mises Institute, As discussed previously, gun-control regulation has a track record of facilitating repressive political regimes. Countries like the Soviet Union, Nazi Germany, Cuba, and present-day Venezuela have witnessed how gun control has given their respective governments a significant advantage in dishing out violence. In recent decades states have acted in many cases to expand rights to gun ownership. There is no guarantee this will continue, however. If current trends are reversed, how could will it happen? Why Gun Control in America Has Been Historically So Limited At first glance, gun confiscation does not appear to be feasible in the United States. With nearly 400 millionguns in circulation, mass gun confiscation is already a tall order. It also helps that the United States’ federalist system fosters a strong degree of institutional competition between states. Citizens and business entities can walk away from states with bad policies that regulate their favorite pastimes and commercial endeavors. Gun companies like Magpul and Mossberg made headlines after moving their operations to more gun-friendly states, when the states they were based in started passing stringent gun control legislation. Such competition between the states puts pressure on politicians to not infringe on their gun rights, lest they want to lose out on commercial activity. Additionally, cultural factors behind gun ownership is heavily ingrained in the civic and cultural DNA of Americans. From hunting associations to grassroots lobbies, Americans have developed powerful civic institutions that are ready to confront the state should politicians try to transgress on their rights. First Circuit Court of Appeals Rule No Right to Bear Arms Outside the HomeAmmoland Inc. Posted on November 5, 2018 by Dean Weingarten U.S.A. -(Ammoland.com)- On 2 November 2018, the First Circuit Court of Appeals held the Second Amendment effectively does not apply outside the home. From uscourts.gov: This case involves a constitutional challenge to the Massachusetts firearms licensing statute, as implemented in the communities of Boston and Brookline. All of the individual plaintiffs sought and received licenses from one of those two communities to carry firearms in public. The licenses, though, were restricted: they allowed the plaintiffs to carry firearms only in relation to certain specified activities but denied them the right to carry firearms more generally. The plaintiffs say that the Massachusetts firearms licensing statute, as implemented in Boston and Brookline, violates the Second Amendment. The district court disagreed, and so do we. Mindful that “the right secured by the Second Amendment is not unlimited,” District of Columbia v. Heller, 554 U.S. 570, 626 (2008), we hold that the challenged regime bears a substantial relationship to important governmental interests in promoting public safety and crime prevention without offending the plaintiffs' Second Amendment rights. Accordingly, we affirm the district court's entry of summary judgment for the defendants. In the last analysis, the plaintiffs simply do not have the right” to carry arms for any sort of confrontation” or “for whatever purpose” they may choose. Id. at 595, 626 (emphasis omitted). The Court specifically said the decision applies to both open and concealed carry of handguns. They reserved the power to infringe on concealed carry more than open carry. www.ammoland.com/2018/11/first-circuit-rules-there-is-no-right-to-bear-arms-outside-the-home/#axzz5XIMrVgWA

Hopefully he is the same way with the 4th, 5th, and 6th Amendments... Wash. police chief says he won't enforce new gun lawThe law raises the legal age to buy a semi-automatic rifle to 21, from 18, and requiring enhanced background checks
By Erik Lacitis, The Seattle Times, 18 Nov 12:35 PM REPUBLIC, Wash. — Loren Culp, the police chief in Republic, pop. 1,100, recently got a big shout-out from Ted Nugent, the “Cat Scratch Fever” rocker who these days is also known for his gun-rights and conservative views, and calls himself the “Motor City Madman.” The reason for the shout-out was that Culp announced he wasn’t going to enforce Initiative 1639, the strict state gun-law measure passed Nov. 6. On his Facebook page with 3.2 million followers, Nugent wrote, “Chief Loren Culp is an American freedom warrior. God bless the freedom warriors.” The initiative that goes into effect Jan. 1 is one of the toughest in the country, raising the legal age to buy a semi-automatic rifle to 21, from 18, and requiring enhanced background checks. The initiative also includes a “safe storage” provision that, in some circumstances, makes firearm owners criminally liable if someone not allowed to access a gun uses it in a crime. That provision won’t apply if, say, a gun is stolen that was secured, such as in a safe, and the owner reports the incident within five days. Not only is the chief — the entire Republic police force consists of Culp and a deputy — not going to enforce the law, but on Monday night, the City Council is going to take up for discussion an ordinance proposed by the chief. He’s titled it the “2nd Amendment Sanctuary City Ordinance,” borrowing the “sanctuary” wording long used to describe places that limit how local law enforcement cooperates with federal immigration authorities. www.policeone.com/chiefs-sheriffs/articles/482125006-Wash-police-chief-says-he-wont-enforce-new-gun-law/

House Dems to introduce gun background checks bill on TuesdayBy JOHN BRESNAHAN, 01/04/2019 01:45 PM EST, Updated 01/04/2019 03:44 PM EST House Democrats will introduce their proposal to require universal backgrounds checks for gun sales on Tuesday, the eighth anniversary of former Rep. Gabby Gifford’s shooting, according Democratic lawmakers and aides. Speaker Nancy Pelosi (D-Calif.) and Rep. Mike Thompson (Calif.) — who heads up a Democratic task force on gun violence — will join Giffords in introducing the bill, which will be dubbed “H.R. 8” in honor of the Arizona Democratic lawmaker. Giffords nearly died in the Jan. 8, 2011, shooting in Tucson, Arizona, which left six people dead and 15 wounded. She resigned from Congress in January 2012. “Since the shooting at Sandy Hook, the Gun Violence Prevention Task Force has been fighting for a chance to pass legislation that will help save lives,” Thompson said in a statement. “Finally, with our new majority that ran on helping to prevent gun violence, we will introduce a bipartisan, universal background checks bill. We will hold hearings, we will have a vote, and this legislation will finally pass the House.” www.politico.com/story/2019/01/04/house-dems-gun-background-checks-bill-1081476

An Open Letter To Our Legislators, Judges And LawmenChuck Baldwin, Published: Thursday, January 31, 2019 I know I am speaking for tens of thousands of my fellow Montanans and tens of millions of my fellow Americans when I write what I’m about to write. The “red flag” laws that are sweeping the country violate every principle of liberty upon which our country was founded. There is no due process associated with “red flag” laws. A judge’s order to seize the firearms from an American citizen who has not been accused of a crime, charged with a crime, convicted of a crime—or who never even threatened to commit a crime—based on the accusation of a single individual is anything but due process. Our accuser could be a disgruntled employee, a bitter ex-spouse or relative, a vengeful neighbor, an anti-gun liberal or even an anti-gun policeman. By definition, “red flag” laws use mere suspicion of what one “might” do as justification to seize a person’s firearms. Tactics such as these have been used in virtually every despotic regime of history. In the name of protecting society, the rights and liberties of individuals were denied. Eventually, these repressive governments included political or religious persuasion as triggering “red flags,” which led to their disarmament—all in the name of public safety, of course. You know as well as I do that when the rights of ONE American are abridged, the rights of ALL Americans are abridged. This is not yet a communist nation where the rights of the state—or even the rights of a majority of citizens—supersede the rights of the individual. Furthermore, it is a fallacy to suggest that a mental health diagnosis, by itself, indicates that someone is automatically a threat to himself or others. Dr. Ann Bukacek, a highly-respected medical doctor in the community in which I live, recently wrote: chuckbaldwinlive.com/Articles/tabid/109/ID/3838/An-Open-Letter-To-Our-Legislators-Judges-And-Lawmen.aspx

N.Y. governor signs ‘red flag’ gun bill, will allow guns to be taken from homesOAN Newsroom, UPDATED 9:15 AM PT — Tuesday, February 26, 2019 Police will soon have the right to take guns away from citizens in New York State if a judge decides they could hurt themselves or others. This notion is the highlight of the bill signed into law by the state’s Democrat Governor Andrew Cuomo, with House Speaker Nancy Pelosi by his side. The law will allow family members, law enforcement as well as administrators and teachers in schools to report individuals, including students, to a judge. Cuomo boasted this is the first ‘red flag’ bill of its kind in the country to include school officials. He stood before supporters at a college in New York City to celebrate. While addressing the audience, Cuomo slammed the president’s idea to arm teachers. www.oann.com/n-y-governor-signs-red-flag-gun-bill-will-allow-guns-to-be-taken-from-homes/

Why gun control will FAIL: People will simply refuse to obey unconstitutional firearms laws because Democrats have set the precedentBy J. D. Heyes, Posted on March 1, 2019 For years Democrat-run states have gotten away with implementing so-called “sanctuary city” policies that contravene federal immigration laws either because Uncle Sam refused to enforce them or, in the age of POTUS Donald Trump, because too many federal judges are better judicial activists than interpreters of the Constitution. The same is true for marijuana laws. Democrat-run states decided a few years ago they would flout federal drug laws prohibiting the recreational use of marijuana by passing state ballot initiatives ‘legalizing’ pot. Mind you, pot’s not legal as far as the federal government is concerned, but when the law isn’t enforced, then lawlessness is what we get. That said, when Democrats are flouting the law, that’s okay; Democrats, as we’re constantly reminded, are the most moral, upstanding, righteous political creatures on the planet. But when others flout laws they pass, then, suddenly, we have a “constitutional crisis” on our hands. thenationalsentinel.com/2019/03/01/why-gun-control-will-fail-people-will-simply-refuse-to-obey-unconstitutional-firearms-laws-because-democrats-have-set-the-precedent/

Lindsey Graham: Democrats, GOP Can ‘Come Together’ for Gun Confiscation LawAWR Hawkins, 9 Mar 2019 Senate Judiciary Committee Chairman Lindsey Graham (R-SC) says firearm confiscation laws portend a way that Democrats and Republicans can “come together.” CNN reported that Graham has long supported red flag laws, which allow a court to issue firearm confiscation orders for individuals deemed a threat to themselves or others. House Democrats have already passed legislation during this Congress to criminalize private gun sales and extend the instant background check for firearm purchases. They are now pressing for $50 million in annual funding to bring academia into the gun control push. www.breitbart.com/politics/2019/03/09/lindsey-graham-democrats-gop-can-come-together-for-gun-confiscation-law/

Hawaii Democrats Want U.S. Congress to Consider Repeal of Second AmendmentBy Susan Jones, March 8, 2019 10:53 AM EST (CNSNews.com) - A resolution introduced in the Hawaii Senate this week urges the U.S. Congress to "consider and discuss whether the Second Amendment of the United States Constitution should be repealed or amended to clarify that the right to bear arms is a collective, rather than individual, constitutional right." The resolution also urges Congress to adopt a proposed constitutional amendment "to clarify the constitutional right to bear arms." The U.S. Supreme Court ruled in June 2008 that the Second Amendment "protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home." The 5-4 ruling in District of Columbia v. Heller also stated, "Like most rights, the Second Amendment right is not unlimited." www.cnsnews.com/news/article/susan-jones/hawaii-democrats-want-us-congress-consider-repeal-second-amendment

Will Red Flag Laws Be Used to Set up Gun Owners?David Codrea, April 16, 2019 Will Red Flag Laws Be Used to Set up Gun Owners? “U.S. Sen. Lindsey Graham supports laws to temporarily revoke guns from people who might harm themselves or others, and he’s working on legislation that would give grants to states that pass such statutes,” The State reports. “It’s a controversial position among gun rights advocates, but the South Carolina Republican’s not worried about alienating his base. “Not my base,” Graham fires back, calling those who oppose his proposed citizen disarmament scheme as “the fringe of the fringe,” adding: “I think most Americans believe that multiple murderers shouldn’t have gun rights. Most Americans support background checks. The Second Amendment’s important to me, but it’s not a suicide pact.” Like all gun-grabbers, he resorts to insults and lies. And stupid lies at that. www.firearmsnews.com/editorial/will-red-flag-laws-be-used-to-set-up-gun-owners/359548

Another day, another infringement... Washington State Toughens Gun Laws, Bans ‘Ghost Guns’Whitney Tipton, 6:17 PM 05/09/2019 Democratic Washington Gov. Jay Inslee signed a series of gun bills into law, including a law banning 3D-printed and other “ghost” guns. Seven gun-related bills with a variety of gun access restrictions became law, including gun removals by police for certain people with restraining orders against them and domestic violence suspects, as well as tightened laws for minors, The Associated Press reported. The bills were passed by a Democratic-majority legislature. “We put forward our most robust legislative agenda ever and got more priority bills passed this session than in all previous sessions combined thanks to our new gun responsibility majority,” said Renee Hopkins, CEO of the Alliance for Gun Responsibility, which worked to pass the legislation, in a statement. Inslee, a 2020 Democratic presidential candidate, told reporters Tuesday during the signing ceremony the legislation would “not only reduce preventable gun violence, but these measures serve as a model for the rest of the United States.” dailycaller.com/2019/05/09/washington-state-gun-laws/

As we have warned, the Second Amendment is in no way safe. Politicians have been licking their chops to get a grip on the Constitutional RIGHT to own weapons for over a century, and as has been stated Ad nauseam; The Second Amendment is NOT about hunting or sport shooting it is about deterring tyranny... and the Government (Federal, State, and Local) has shown nothing but contempt for this Constitutional Amendment for years. The point of the the constant attacks on the Second Amendment? Control and submission of the populace. Every single 2020 DemocRat is all in for gun control, almost all are calling for federal gun registration and CONFISCATION in direct violation of the Second Amendment(Shall Not Be Infringed), not to mention the violations of the 4th, 5th, 6th, and 7th Amendments to the Bill of Rights. But now there is a difference; many REPUBLICANS, including Trump, are joining them in this unconstitutional frenzy. We must engage hard, or become a England, Australia or New Zealand. Now we have public and private corporations joining the politicians in an attempt to subvert the Second Amendment; Walmart, Kroger, Target, Walgreens, CVS, and Dick's just to name a few. The answer is to take your business elsewhere and/or minimize the patronage to these establishments. To keep supporting Politicians, Groups or Companies that are destroying your Right to self-defense is beyond idiotic.

Corporations upsetting the ConstitutionBy Cheryl K. Chumley, The Washington Times - Saturday, September 7, 2019 In recent days, in rapid succession, retail giant Walmart, the Kroger grocery chain and Walgreens pharmacy, as well as CVS and Wegman’s Food Markets, all announced curbs on open firearms’ carry on their premises, with exceptions, that is, carved for law-enforcement officers. What a clash of Constitution and capitalism. The stage is being set for a showdown between the Second Amendment and the free market. And given the number of shootings in recent times, the frustration and fear of the citizenry and the all-courts-press of the Democrats and left to crack down on gun rights, come heck or high water, the fact is America, on Second Amendment freedoms, is marching toward tough times. We’ve let business stick its nose where it doesn’t belong. www.washingtontimes.com/news/2019/sep/7/corporations-upsetting-constitution/

HAVE THEY LOST THEIR MINDS?By John C. Sigler “San Francisco officials brand NRA a ‘domestic terrorist organization’” – that was the headline in the September 4, 2019, Fox News article by Adam Shaw. According to Shaw, “The San Francisco Board of Supervisors has passed a resolution declaring the National Rifle Association a “domestic terrorist organization” and urged the federal government to do the same, alleging that the NRA is using “its considerable wealth and organization to promote gun ownership and incite gun owners to acts of violence”. “Have they lost their minds” you ask? No, probably not. My guess is this is all part of one, well-planned, well-considered and well-executed “grand scheme.” They know exactly what they are doing. They care little about facts or the truth. And they certainly don’t care about defaming over 5 million law-abiding gun owners who proudly belong to America’s oldest, strongest and largest civil rights organization. They know the truth about you and the NRA, but to them the truth is merely an inconvenience to be brushed aside, ignored, denigrated, and lied about in favor of their progressive “grand scheme”. They know that NRA is an organization that has, for the past 148 years, promoted firearm safety, adherence to the laws of the land, respect for our flag, our history, our culture, our heritage and the principles of good government, and obedient, loyal and patriotic citizenship. And they know that NRA has never incited anyone, member or non-member, to acts of violence. In fact, they know the opposite to be true. They know for a fact that NRA members are among the most law-abiding, peace-loving, God-fearing, respectful and patriotic members of our society. Then why are they doing this? The answer is simple. www.thegunwriter.com/24837/guest-column-have-they-lost-their-minds/

Gun control: Campaigning vs. legislatingBy Amitai Etzioni, 09/15/19 12:00 PM EDT Much attention has been paid recently to the policy differences between moderate and progressive Democrats. But at least as big a difference separates the way Democrats campaign for office and the way they act once they get elected. That’s especially true on the issue of guns. The House Democrats recently showed courage by passing a universal background check bill, which would close most of the loopholes that plague the gun laws on the books. It took courage because many of the new Democratic House members were elected in red districts and face reelection in 2020. Even the weakened National Rifle Association may give them much grief for these votes. While I cherish every life saved, truth to be told, even if Congress acts to close all the background check loopholes, it would curb few of the shootings. Most of the recent mass shooters passed background checks and obtained their guns legally. thehill.com/opinion/campaign/461449-gun-control-campaigning-vs-legislating

The Battle is Raging on Capitol HillWritten by Erich Pratt Published: 13 September 2019 We Can Win This! In case you missed the earlier news, GOA activists have sent more than THREE MILLION messages to Capitol Hill and the White House. GOA’s grassroots have definitely risen to the challenge! Despite all the media hype that you’re hearing in favor of 2A restrictions, Democrats are VERY worried that their gun control proposals will not pass. Anti-gun Senator Chris Murphy of Connecticut said he “puts the chances of a deal on expanding background checks at less than 50-50, because of pressure from the gun lobby.” And a high-ranking Senate office told GOA that the anti-gun Left’s push for gun control would “already be a done deal” were it not for the loud response from GOA’s activists. So if you didn’t send our recent pre-written letter, please Take Action here. It’s imperative that we continue deluging House Republicans in opposition to the three gun control bills that passed out of Judiciary Committee this week. Your voice in Washington is desperately needed right now. Check Out What GOA is Doing in Defense of 2A! While GOA’s grassroots have been pounding Congress, GOA spokesmen have been blanketing the airwaves in defense of our rights. Here are just some of the recent postings that you can view: 1) In response to calls for gun control after the recent Texas mass shooting, GOA produced a video of El Paso residents speaking out to reject calls for gun control. You can check it out here. 2) GOA also sent Representatives and Senators several “shots across the bow” during the past month. In a series of letters — seen here, here and here — GOA warned congressmen that gun control is a political loser that will cost them greatly on Election Day. 3) On the airwaves, I joined News Talk 995 to discuss Walmart’s anti-gun moves that restrict firearm freedoms. I joined IraqVeteran8888 to discuss legislation in Congress and to explore the current state of Second Amendment. And I engaged in a “free for all” with gun rights activist Antonia Okafor — discussing everything from my journey to becoming a 2A-activist to explaining the strategy for defeating gun control legislation in Congress. 4) GOA’s Rachel Malone blasted Texas Gov. Greg Abbott’s executive actions on gun control on KTRH. And she slammed “red flag” gun grabs in an editorial that was published by The Truth About Guns. 5) Finally, writing in the Daily Caller, GOA’s John Velleco explains how two of the chief pillars of liberty are the Second Amendment and due process of law — and yet in one sweeping move, red flag gun confiscation orders will destroy both of these foundational protections. Again, please make sure that you Take Action here. And I hope you enjoy seeing all that your GOA has been doing! gunowners.org/the-battle-is-raging-on-capitol-hill/
