Court strikes down rule forcing toy drone users to register with govt

A D.C.-based appeals court struck down a Federal Aviation Administration (FAA) rule on Friday requiring recreational drone users to register their model aircraft with the federal government, in a major win for drone hobbyists.
The U.S. Court of Appeals for the D.C. Circuit sided with plaintiff John A. Taylor, a recreational drone pilot, who argued that the FAA doesn’t have the power to make him register his toy drones because Congress already said the FAA can’t regulate model aircraft.
“The FAA’s 2015 registration rule, which applies to model aircraft, directly violates that clear statutory prohibition,” the opinion said. “We therefore grant Taylor’s petition and vacate the registration rule to the extent it applies to model aircraft.”
Since the court has ruled they can't force you to 'register your drone, the trump admin will just destroy it when they feel like it, with no judicial oversight or civil recourse... yeah that's real Constitutional, Not!

The Trump administration is asking Congress to give the federal government sweeping powers to track, hack and destroy any type of drone over domestic soil with a new exception to laws governing surveillance, computer privacy and aircraft protection, according to a document obtained by The New York Times.
The document is a 10-page draft and summary of legislation the executive branch circulated among several congressional committees on Tuesday, according to a congressional aide. The administration also scheduled a classified briefing on Wednesday for congressional staff members to discuss the topic, the aide said.
The government has expressed growing concern about the proliferation of small drones — including several that have flown over sporting events and one that crash-landed over the White House fence in 2015 — and the potential for terrorists to use them to carry bombs or other weapons into secure areas.
The draft bill’s language would authorize the government to summarily track, seize control of and use force to destroy any unmanned aircraft it determines may pose a security threat to an area designated for special protection.

Sen. Dianne Feinstein, D-Calif., wants drones regulated, and she wants them regulated now. And, along with strong bi-partisan support, the goal is to have them primarily regulated at the state and local level.
It won’t happen in Washington. A federal appeals court in Washington, D.C., ruled last month the Federal Aviation Authority lacks authority to regulate drone use by hobbyists or to require they register their drones in a national database, and legislation the senator introduced to regulate drones in the last Congress went nowhere.
So she has opted for another approach. She has joined forces with Sen. Richard Blumenthal, D-Conn., a frequent ally, and Sens. Mike Lee, R-Utah, and Tom Cotton, R-Ark., with whom she agrees less often, to introduce legislation that would let states and local governments regulate drones themselves.
