the lack of further shooting after Finicum goes down is an indicator of restraint on both sides Not true. freenorthcarolina.blogspot.com/2016/01/finicum-this-whole-takedown-was-very.htmlAt 9:49 Finicum is down and dying and we switch our focus to the vehicle as the helicopter circles. I would like to take more time and focus on the actions of all the LEOs at the roadblock, something I have not had time to do so far, having only played this several times, the focus being on the action at the white truck. That would be a worthwhile Intel effort. Anyway, as the helicopter circles, and is obscured at times by trees, we see non-lethal ‘flashbangs’ impacting on and near to the vehicle. It is hard to tell if any lethal rounds are fired initially, as the vehicle sits there. These flashbangs, as designed, would have been terrifying to an inexperienced person such as Victoria, huddled low in the vehicle. There is what looks like snow kicked up in the area of the passenger side window, either from non-lethal or lethal rounds. When I first watched this on my phone, it looked like rounds impacting the side window. It may also be non-lethal kicking up snow. 8) At 10:22 I am not sure what is impacting the passenger side of the vehicle, whether non-lethal, shotgun or rifle rounds. If it is bangers, there is no accompanying flash at this time. At 10:47 there are more of these impacts, which look to me like the vehicle is being stuck by rounds (lethal or non-lethal), not kicked up snow. Whatever is being used, are they trying to suppress and dominate the passengers remaining in the vehicle, who are huddled on the floorboards at this time, as per their statements? 9) At 11:30 you have a group of officers moving out to the back of the vehicle to cover its left side. Bear that in mind as the helicopter circles. 10) At 12:13, through the gap in the tress, you see what look like multiple impacts onto the window of the camper shell of the truck. Is this hitting at an angle from the guys to the rear left of the truck? Go to point 13 for a revision on this – it may well be tree shadow instead. At 12:20 you see impacts on, through or inside the windshield, which I initially thought may be a result of through-and-through rounds coming through the camper shell, through the cab, and out the windshield. On further viewing (coming back from point 13), I think the ‘impacts’ on the camper shell window are shadow, and what can be seen on/inside the windshield may well be non-lethal gas clouds being shot into the cab through the side windows, and impacting inside. I would also consider that some of these impacts could be from non-lethal rounds, such as pepper / CS rounds, which Victoria says were used (she said gas was used). At 13:20 there is a red dot playing on the left side of the truck, and then what look like white impacts into the driver side window, on the console. Is this SAF, or perhaps gas/pepper rounds? Have these side windows been shot out? 11) At 13:42 you see the red laser playing on Finicum’s head. 12) At 14:08 we are now back around with the helicopter and you see what looks like shattered safety glass in the passenger window which was not like that on the first pass around. Shot out? At around 15:00 the agents are milling around behind their vehicle, with individuals popping out to either take shots or at least aim their rifles at the truck. Are they now giving orders to the occupants to surrender and exit the vehicle? 15:06 the left side truck door appears to be open. Someone gets out with hands raised and tosses something to the ground, probably a handgun. There is a red laser playing around on him. From this point onward, the occupants are getting out and being taken into custody. 13) 15:43: OK, go back and see point 10: I see the same effect on the left window of the camper shell. I don’t see why there would be any shooting at this time – on further inspection, it may be a play of the shadow of the trees on the window? There is however smoke drifting at 16:00 – CS gas?

swordattheready.wordpress.com/2016/02/01/denial-and-normalcy-bias-in-the-face-of-tyranny/Denial And Normalcy Bias In The Face Of TyrannyLavoy Finnicum’s shooting death has fostered an argument among self-described Patiots over whether or not he had it coming and deserved it, or if it is just another example of a totalitarian state we are comfortable with. I’m reading it all over the place on Conservative discussion forums and blogs: the argument whether the ambush and shooting death of Lavoy Finnicum and the arrest of Ammon Bundy and the other protestors in Oregon was justified. The arguments are downright vicious and threatening of themselves and they reveal several things about the situation in America that does not bode well for Liberty and private property to exist much longer in a nation that has grown comfortable with tyranny. As an observation, I find it interesting that there was no division among the Democrat Left over the actions of Michael Brown, Black Lives Matter, The New Black Panthers or Occupy Wall Street protesters who actually engaged in acts of criminality, mayhem, intimidation, death and destruction. Instead they were in lock-step support of those groups and actions, whose leaders were all invited to the White House for pow-wows with Obama and given legitimacy by the media and a vast expanse of the populace. No such unanimous support is found among a vast expanse of the ideological “Right” or the Patriot movement over the Bundy’s efforts to stand against federal tyranny over private property rights. Not saying there should be, but I do find it interesting that the domestic enemies of the Constitution and republicanism are not divided over their banner men. Conservatives, not so much. Rather than getting into semantics over actions Finnicum made in his final moments, I want to share a larger point I made about why there was even a protest against the Federal Beast in Oregon to begin with. That point is this: NONE of this would have ever happened had the Federal Beast been adhering to it’s limits within the bounds of the Constitution. A rancher family would not be imprisoned for doing what was necessary on their own land to protect their home from a lighting fire. Sadly, few wanted to discuss that, and those that did sound no different than the politicians in D.C. that have empowered tyranny to become a staple that the American people are now comfortable with. We are witnessing just more of what Jefferson wrote when he penned in the Declaration all experience has shown that men are disposed to suffer evil, while evils are sufferable rather than abolish the forms to which they have become accustomed. In response to a statement that declared Finnicum’s actions mistakes that justified his execution, I made the point that when a tyrannical government no longer has any legitimate moral authority and is busy imposing tyranny and arresting and executing citizens it declares terrorists – at what point should we realize that it is better to die fighting than begging on our knees for mercy from a despotic beast? Why do we refuse to recognize tyranny at the hand of the Beast in Washington? That was when the scourge of Normalcy Bias and Denial revealed how entrenched it is in the minds of those we assume are on ‘our side’. The reply was that Finnicum was completely wrong on every count of his actions that resulted in his shooting death. It is wrong they said, to evade a roadblock, no matter the circumstance. No matter who it is in uniform, or why they are there – one must always comply with the directives given. So I asked in an analogy, that if this was 1774 would we be writing that the Colonists at Lexington Green acted completely wrong? That they should have never been on the Common and never assembled in formation against the British Regulars after that first command from Pitcairn to disarm and disperse? That they should have NEVER fired that first shot at a superior British force and NEVER should have resisted when the British regulars charged with bayonets and skewered John Parkers men? I stated I was curious as we denounce those who actually stood in defiance of tyranny as being stupid. Had the Colonists lost Concord, I am sure the historical analysis would be about the same as it is being levied against Bundy and Finicum right now. The fact they stood at all should be of primary importance to consider, rather than the tactical error they may have made leaving the refuge in the first place. At some point we have to resist, because the longer it takes for us to do so, the less chance we have to preserve what liberty we have left, and eventually our own lives. Evading ambushes are not grounds for surrender either as some suggest. The fact is, much of the Revolutionary War was a series of ambushes set up by the Redcoats, and there are myriad examples during the War of Independence of Washington’s miraculous escapes from one set of ambushes after another. At some point, we have to begin wrapping our minds around the fact that the State is imposing despotism upon us. We are being ambushed every day by the cabal in DC: laws passed in the middle of the night in thousand-page bills that not a single representative has read that abolish by fiat your inalienable rights under mountains of regulatory control over every aspect of your life and property. Do we surrender to it, or resist it? Because that is where we have arrived, whether we would admit it or not. Resistance or acceptance.

www.ammoland.com/2016/02/responses-to-malheur-crisis-show-deep-divisions-within-patriot-community/#axzz3z401ZQyDResponses to Malheur Crisis Show Deep Divisions within Patriot CommunityBy David Codrea We’ve all seen no shortage of angry comments in various forums calling for escalation of the Malheur situation. Some demand showing up in force at the refuge, or confronting authorities surrounding it. Others demand expanding shows of armed defiance nationwide. A common factor among many is that some of the loudest voices are complaining about what others aren’t doing. What they themselves are doing, and their qualifications for expecting others to follow their recommended courses of action, is in many cases left unsaid.

Rutherford Institute Warns Against Government Attempts to Intimidate Journalists by Prosecuting Radio Shock Jock Pete Santilli Over Oregon StandoffRutherford Institute, February 02, 2016 PORTLAND, Oregon — Warning against attempts by the government to intimidate journalists whose reporting portrays the government in a negative light or encourages citizens to challenge government injustice and wrongdoing, attorneys for The Rutherford Institute have weighed in on the government’s arrest and ongoing prosecution of radio shock jock Pete Santilli. Santilli, a new media journalist who broadcasts his news reports over YouTube and streaming internet radio, was arrested and has been charged along with seven other individuals connected to the recent occupation of the Malheur National Wildlife Refuge in Burns, Oregon. Santilli is the only journalist among those who have been charged with conspiracy to impede federal officers from discharging their duties by use of force, intimidation, or threats. In advising the public defender about the First Amendment principles at play in Santilli’s case, Rutherford Institute attorneys took issue with the government’s case against Santilli as laid out in its Criminal Complaint, which makes clear that Santilli is being charged solely as a reporter of information and not as an accomplice to any criminal activity. The Rutherford Institute’s memorandum on the First Amendment rights of journalists and the government’s complaint regarding Santilli are available at www.rutherford.org. www.rutherford.org/publications_resources/on_the_front_lines/rutherford_institute_warns_against_government_attempts_to_intimidate_journa

(Reuters) – Four anti-government activists still occupying a U.S. wildlife refuge in Oregon have been indicted along with 12 others previously arrested on charges of conspiring to impede federal officers during a month-long armed standoff at the compound. The indictment, returned by a federal grand jury in Portland on Wednesday and unsealed on Thursday, supersedes an earlier criminal complaint in the case. It accuses protest leader Ammon Bundy and others of plotting to prevent by “force, intimidation, and threats” agents of the U.S. Fish and Wildlife Service in the performance of their duties. www.oann.com/four-protesters-still-occupying-oregon-wildlife-refuge-charged-indictment/

ncrenegade.com/editorial/cliven-bundy-arrested-oregon-refuge-occupiers-say-theyll-surrender/Cliven Bundy Arrested; Oregon Refuge Occupiers Say They’ll SurrenderNevada rancher Cliven Bundy, the father of the jailed militia leader whose followers have occupied a federal wildlife refuge in eastern Oregon for the past 40 days, was arrested by FBI agents in Portland, Ore. late Wednesday as he stepped off a flight from Las Vegas. Bundy’s arrest was confirmed on the website of the Multnomah County Sheriff’s Office, which said he had been booked in to the Multnomah County Detention Center shortly before 11 p.m. local time. The FBI also confirmed Cliven Bundy’s arrest but declined to provide a reason or other details, saying further information would be released by the U.S. Attorney’s office in Las Vegas Thursday. The Oregonian newspaper reported that Bundy faces charges related to the 2014 standoff between federal agents and militia members on his Nevada ranch. The charges include conspiracy to interfere with a federal officer, the same charge lodged against two of Bundy’s sons, Ammon and Ryan, for their role in the ongoing standoff at the Malheur National Wildlife Refuge.

h/t to freenorthcarolina for link... Forensic Analysis of the Murder of LaVoy FinicumPosted on September 27, 2016, by David Robinson Note from Elias Alias, owner/editor: I want this video to be posted for date lock-in as quickly as possible. You will note at my YouTube channel that I posted this video on the morning of September 24, 2016. And on the Oath Keepers national website, where I have been the senior editor for seven years. Some hours later, owing to some dissent among Oath Keepers national leadership, the video was marked “Private” and removed for an undetermined period of time, after which the video may, or may not, be returned to public visibility at the Oath Keepers national website. I am guessing that this video will qualify for renewal at Oath Keepers after a committee determines its veracity. Personally, speaking for myself here at The Mental Militia, this video is quite believable. Thank you for viewing this very important video. mainerepublicemailalert.com/2016/09/27/forensic-analysis-of-the-murder-of-lavoy-finicum/

Bundy Prosecutors Admit That Undercover Informants Outnumbered Defendants In Recent TrialBy Roger I. Roots, J.D., Ph.D., October 24, 2016 For the past six weeks Oregonians have been treated to a political trial of the “Malheur 7” (Ammon Bundy, Ryan Bundy, Shawna Cox, Jeff Banta, David Fry, Neal Wampler and Ken Medenbach,). I was privileged to have a ringside seat at the trial as a volunteer researcher and paralegal for Ryan Bundy (who represents himself) at the trial. As I write these words, the jury is out, considering whether the defendants conspired to prevent U.S. Fish & Wildlife Service or Bureau of Land Management officers from performing their duties at the Malheur National Wildlife Refuge in rural eastern Oregon. The Bundy brothers and other defendants are alleged to have participated in an “armed standoff” occupation of the Refuge during January 2016 (while protesting the unconstitutional occupation by the federal government itself over the Refuge and other public lands). www.lewrockwell.com/2016/10/roger-roots/persecution-bundy-good-guys/

The Bundy brothers and occupiers Jeff Banta and David Fry also were found not guilty of having guns in a federal facility. Kenneth Medenbach was found not guilty of stealing government property, and a hung jury was declared on Ryan Bundy's charge of theft of FBI surveillance cameras. Total corruption of justice, the govt WILL have their pound of flesh... Misdemeanor charges against second round of Oregon standoff defendants will go before a judge, not juryBy Maxine Bernstein, on January 27, 2017 at 12:21 PM, updated January 27, 2017 at 1:01 PM The misdemeanor charges filed against the second round of Oregon standoff defendants will be tried before a judge. Because the charges of trespass, tampering with vehicles or equipment and destruction of property are Class B misdemeanors and considered petty offenses, the defendants don't have a right to a jury trial, U.S. District Judge Anna J. Brown ruled. The judge also cited the "significant uncertainty in the law'' as to whether she has discretion to allow a jury trial for such offenses. www.oregonlive.com/oregon-standoff/2017/01/misdemeanor_charges_against_se.html

BLM Agent Daniel P. Love Named in Investigationby Shari Dovale, February 19, 2017 The truth is being revealed, as we all prayed that it would. Bureau of Land Management (BLM) Agent Daniel P. Love has been breaking the law for years. Using and abusing his authority to run his own personal fiefdom. Bullying citizens until they commit suicide. All while believing he was above the law. Or so a report released last month seems to indicate. Yet, when the information was released, the report redacted his name and the public was left to guess at who it was referring to. There was enough information to conclude that the investigation likely focused on Love, but it was only this week that this was proved to be true. On February 14th, a letter from U.S. Reps. Jason Chaffetz, R-Utah, and Blake Farenthold, R-Texas, named Daniel P. Love and questions an investigation that points to the deletion of hundreds of documents the day before a congressional investigative committee issued a subpoena for these documents. redoubtnews.com/2017/02/19/blm-daniel-love-named-investigation/

BLOGGER GARY HUNT ARRESTED Thursday, March 30, 2017 Gary Hunt was arrested in northern California today. Hunt's "Outpost of Freedom" blog published posts outing informants in the Oregon Standoff case. The federal government has been trying to get him to take down the posts. Hunt did not appear in court in Portland for a contempt hearing after being given an order to take his posts down. Hunt said on his blog that he does not recognize the authority of a court in Oregon since he posts from California. The end game for James Comey's FBI and the Acting US Attorney in Oregon appointed by the Obama Administration, Billy Williams (NOT REMOVED BY THE TRUMP ADMINISTRATION) is to compel Gary Hunt to remove his blog posts. Hunt made his posts based on redacted government documents and interviews with people involved in the Oregon Standoff. From that he uncovered who the informants were.in the case. The violation of Constitutional Rights is all over Oregon from matters related to land and due process and here the First Amendment's freedom of speech and freedom of the press. ) Posted by York Report at 2:39 PM nextrushfree.blogspot.com/2017/03/blogger-gary-hunt-arrested-gary-hunt.html

Partial Verdict Announced In The First Bundy Ranch TrialBy Kit Perez, Apr 24, 2017, Updated at 4:04pm EST, April 24, 2017 The first Bundy trial has ended in a mistrial after finding a federal informant guilty of eight charges and one of the defendants guilty of two lesser charges. The jury was hopelessly deadlocked on sixty more charges, even after federal judge Gloria Navarro sent the jury back to deliberate further. The case has been hotly contested by their supporters, who say that the men were defending themselves against government agents who assaulted, tazed, and threatened them. Todd Engel was found guilty on two charges; obstruction of justice, and interstate travel to aid extortion. Greg Burleson, a fellow defendant also revealed to have been working for the federal government as an informant throughout the events at Bundy Ranch, was found guilty on eight charges. According to Maxine Bernstein of OregonLive.com and Jenny Wilson of the Las Vegas Review-Journal, the jury was “hopelessly deadlocked” on all other charges — including the charge of conspiracy against the United States government. Federal judge Gloria Navarro has reportedly sent the jury back on an Allen charge to deliberate further on the other counts, but to no avail. libertynation.com/bundy-trial-verdict/

LaVoy Finicum shooting: Indictment of agent 'devastating' for FBIBy Maxine Bernstein, The Oregonian/OregonLive, Updated on June 28, 2017 at 9:04 PM Posted on June 28, 2017 at 8:01 PM An indictment accusing an FBI agent of lying to hide that he fired two shots at Robert "LaVoy" Finicum and missed caps an 18-month investigation that began with Oregon sheriff's detectives who followed "where the evidence led," their commander said Wednesday. Deschutes County Sheriff Shane Nelson credited his investigators for their tenaciousness and said he was "disappointed and angry'' that the FBI agent's alleged deceit and actions "damage the integrity of the entire law enforcement profession.'' The sheriff also revealed that FBI leaders, told of his department's findings more than a year ago, didn't put the agent or four of his colleagues on leave. They were all members of a Hostage Rescue Team assigned to help arrest the leaders of the armed takeover of the Malheur National Wildlife Refuge. The indictment of W. Joseph Astarita, 40, of New York casts a shadow on the highly trained team. www.oregonlive.com/oregon-standoff/2017/06/fbi_agents_indictment_resulted.html

The government has done everything they can to railroad these Citizens, stacking the deck to extremes... The 'Judge' and 'Prosecutors' should be disbarred and sent to prison for their actions in denying these men their Constitutionally guaranteed day in court, every Oath Breaking LEO that took part in this fiasko should lose their badges and gain some prision time... But this is the new America, where 'Qualified Immunity' rules the day. Bundy Ranch standoff trial ends with zero guilty verdictsRobert Anglen, The Republic | azcentral.com Published 4:42 p.m. MT Aug. 22, 2017 | Updated 9:00 p.m. MT Aug. 22, 2017 "It wasn't one thing," Marchese said about what led to their verdicts. "They (jurors) said it didn't make sense." The case went to the jury Tuesday after lawyers for all four defendants waived closing arguments as part of a protest about court proceedings and restrictive legal rulings. "The jurors knew our hands were tied," Perez said. "By the time the government laid it all out for them, they had already made up their minds ... They knew there was no reason for us to go farther." Perez said the government's string of witnesses, largely composed of local, state and federal law-enforcement officers, became both repetitive and contradictory, according to jurors. So you thought the Constitution would protect you from vindictive and corrupt government agents, yeah not so much... and this is being done by the Trump admin. Unbelievable! Government to Retry Bundy Ranch Defendants a Third Time!Tim Brown, August 24, 2017 These tyrants just can't let it go. They can't make their case to the jury to find these men guilty so they are going to try them a third time and push other defendants' court date back further into the future! After the jury acquitted two defendants in the Bundy Ranch case of all charges against them, they were deadlocked on two others, O. Scott Drexler and Eric Parker, both of Idaho. Still, they were released from prison on Tuesday evening, but discovered on Wednesday that the government, who could not make their case to the jury, want to try them again. "Surprised? No. Disappointed? Yes," said Parker's lawyer, Jess Marchese. "It's clear at this point the prosecution is taking this personally now." Marchese said Acting Nevada U.S. Attorney Steven Myhre twice called Parker a coward during a court hearing Wednesday. Marchese said it was unprofessional and unnecessary. "This is a business," he said. "And there's no need for emotion in a business." It's actually pretty cowardly what Mr. Myhre has been involved in, in attempts to bring in situation and conduct that occurred well after Bundy Ranch against defendants to make his case, as well as being just fine with holding defendants up to five years without worrying about violating their right to a speedy trial. freedomoutpost.com/unbelievable-government-retry-bundy-ranch-defendants-third-time/

A corrupted DOJ investigating itself... just more bullshit theatrics. There should be serious prison time for all involved, but as usual, a cushy retirement and life-long government pension will take care of the transgression... DOJ Opens Probe Into Bundy Prosecutors Who Hid EvidenceTim Pearce, 6:23 PM 12/22/2017 The Department of Justice (DOJ) has opened a probe into federal prosecutors of the recent trial of Nevada rancher Cliven Bundy, E&E News reports. Bundy faced criminal charges related to a 2014 standoff with Bureau of Land Management (BLM) agents. After the prosecutions numerous missteps and “willful” withholding of evidence that would aid the Bundy’s defense, the judge ruled a mistrial Wednesday, The Oregonian reports. The DOJ did not say whether it would pursue another trial against Cliven Bundy and others involved in the 2014 standoff, according to E&E News. Attorney General Jeff Sessions “personally directed that an expert in the department’s discovery obligations be deployed to examine the case and advise as to next steps,” DOJ deputy director of public affairs Ian Prior told The Oregonian. “This is every prosecutor’s nightmare,” retired federal prosecutor Kent Robinson said. dailycaller.com/2017/12/22/doj-opens-probe-into-bundy-prosecutors-who-hid-evidence/

Duane stated that the main purpose of his ride was, not to call attention to the injustice being heaped on him by a corrupt federal justice system, but to call attention to the plight of the Hammonds, the ranching family in Oregon. To extract the maximum amount of benefit from Duane’s last ride, the sacrifice of LaVoy Finicum, who laid down his life for reasons related to the Hammonds and the greater cause of liberty, and the sacrifice made by the Bundys and many others, it is time to revisit the Hammond story and how it ties into the bigger picture. redoubtnews.com/2018/01/shocking-conscience-hammond-story/

Charges against rancher Cliven Bundy, three others are dismissedBy Steve Kurtz, 8 Jan 2018 A federal judge dismissed all charges against Nevada rancher Cliven Bundy, his two sons and another man on Monday after accusing prosecutors of willfully withholding evidence from Bundy’s lawyers. U.S. District Judge Gloria Navarro cited "flagrant prosecutorial misconduct" in her decision to dismiss all charges against the Nevada rancher and three others. "The court finds that the universal sense of justice has been violated," Navarro said. www.foxnews.com/us/2018/01/08/charges-against-rancher-cliven-bundy-three-others-are-dismissed.html

Finicum family files wrongful death lawsuit against FBI, BLM, Oregon State Police and othersUpdated Jan 27; Posted Jan 26 2018, By Maxine Bernstein The family of Oregon occupation spokesman Robert "LaVoy" Finicum filed a wrongful death lawsuit in federal court against the United States, the FBI, Oregon State Police, the U.S. Bureau of Land Management, Oregon's governor and others on the second anniversary of his death. The complaint claims Finicum was shot "assassination style'' by "one or more militarized officers of the Oregon State Police and/or FBI'' as he was trying to drive "across the county border'' to seek the protection of Grant County Sheriff Glenn Palmer on Jan. 26, 2016. The suit likened it to what happened to a North Korean soldier who was shot while running across the border last November to South Korea, though he survived. "Finicum was deliberately executed by a pre-planned government ambush, after he had exited his vehicle with his hands up,'' the complaint says. www.oregonlive.com/oregon-standoff/2018/01/finicum_family_files_wrongful.html
