The 'People' win a small one... Federal Appeals Court: No "Qualified Immunity" Defense For Officers Who Engaged In Blatantly Unconstitutional RaidGeorge Leef, 9/24/2014 @ 10:00AM For decades, most courts have been far too deferential towards authoritarian laws and hyper-aggressive enforcement. That a majority in Berry decided against the “qualified immunity” defense raised by the officials is a hopeful sign that things may be changing. The case will proceed and the crucial matter will be the remedy. Berry and his co-plaintiffs seek punitive and compensatory damages as well as injunctive relief from future “inspections” of this sort. Combined with the strong ruling by the 11th Circuit, a verdict that has a sharp financial sting for the defendants might help to deter future unconstitutional actions by law enforcement officers and regulatory minions. www.forbes.com/sites/georgeleef/2014/09/24/federal-appeals-court-no-qualified-immunity-defense-for-officers-who-engaged-in-blatantly-unconstitutional-raid/
